By accessing or using the Gamdato website (gamdato.com) and services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you are expressly prohibited from using our services and must discontinue use immediately. These Terms constitute a legally binding agreement between you and Gamdato. We reserve the right to modify these Terms at any time, and your continued use of the services after such modifications constitutes acceptance of the updated Terms.
Gamdato provides a backend-as-a-service (BaaS) platform for game developers. Our services include, but are not limited to: online leaderboards with custom scoring, sorting, and ranking; cloud saving and player data persistence; an achievements system with custom definitions and unlock tracking; player management with automatic identification and nickname systems; encrypted API communication between games and our servers; and a developer dashboard for managing games, leaderboards, and API keys. Currently, our services officially support GameMaker Studio 2.3+, with plans to expand to additional game engines and platforms.
To access our services, you must create an account. You agree to: provide accurate, current, and complete information during registration; maintain the confidentiality of your account credentials, including your password; be solely responsible for all activity that occurs under your account; immediately notify us of any unauthorized use of your account or any other security breach; maintain the security of your game credentials, including Game IDs, API Keys, and Table Keys; and not share your API keys publicly or embed them in client-side code where they could be extracted. We reserve the right to suspend or terminate accounts that violate these Terms, contain inappropriate or offensive usernames, remain inactive for extended periods, or show signs of unauthorized or fraudulent activity.
Gamdato offers both free and paid subscription plans. For paid plans: all payments are processed securely through Stripe with 256-bit SSL encryption; subscriptions are available in monthly and yearly billing periods; prices are displayed in USD and charged at the beginning of each billing cycle; you authorize us to charge your payment method on a recurring basis until you cancel; you may cancel your subscription at any time through the billing portal or by contacting support; cancellations take effect at the end of the current billing period, and you retain access to paid features until then; we offer a 30-day money-back guarantee on new subscriptions; refund requests after 30 days are evaluated on a case-by-case basis; and we reserve the right to change prices with at least 30 days notice before the next billing cycle.
Our free plan provides access to basic features with certain limitations, including a maximum number of games, leaderboards per game, and scores displayed per leaderboard. These limits are defined by platform-wide settings and may be adjusted at our discretion. Paid plans offer higher or unlimited usage limits as specified in the plan details. Exceeding the limits of your plan may result in restricted functionality until you upgrade or reduce usage.
Use of the Gamdato API is subject to rate limits designed to ensure fair usage and platform stability. You agree to: use API keys only for their intended purpose within your games; not share, publish, or expose API keys in public repositories or client-side code; implement appropriate error handling for rate limit responses; not attempt to circumvent rate limiting through multiple accounts or other means; and not use the API for purposes other than integrating backend services into your games. We reserve the right to throttle, suspend, or revoke API access if we detect abusive, excessive, or unauthorized usage patterns.
You retain ownership of all content and data you submit to Gamdato, including game configurations, leaderboard structures, cloud save data, and achievement definitions. By using our services, you grant us a limited, non-exclusive, worldwide license to store, process, and transmit your content solely for the purpose of providing the services. You are solely responsible for: the legality, accuracy, and appropriateness of all content submitted through your account; ensuring you have the necessary rights to submit and use all content; backing up your data (while we implement robust data protection measures, we recommend maintaining your own backups); and complying with applicable data protection laws when collecting and processing player data through our API.
By using our leaderboard services, you acknowledge and agree that: leaderboard data (player nicknames, scores, rankings, and custom fields) is publicly accessible by design; you are responsible for informing your players that their leaderboard data will be publicly visible; player nicknames should not contain personal identifiable information, and you should advise your players accordingly; and we are not responsible for any personal information that players voluntarily include in their nicknames or custom fields.
You agree not to engage in any of the following activities: using our services in violation of any applicable local, national, or international law or regulation; uploading or transmitting viruses, malware, trojans, or any other malicious code; employing automated systems such as bots, scrapers, or data mining tools to extract data from our platform; attempting to reverse engineer, decompile, or disassemble any portion of our software or services; impersonating another user, person, or entity; selling, transferring, or sublicensing your account or API keys to third parties; interfering with or disrupting the integrity or performance of our services or infrastructure; attempting to bypass security measures, access restrictions, or rate limits; submitting false, fraudulent, or misleading information; abusing our support services or submitting false reports; using our services to facilitate illegal activities or harm others; removing, altering, or obscuring any copyright, trademark, or other proprietary notices; and accessing or attempting to access another user's account or data without authorization.
The Gamdato platform, including its website, API, documentation, logos, trademarks, and all related content, features, and functionality, is owned by Gamdato and is protected by copyright, trademark, patent, trade secret, and other intellectual property laws. You may not: reproduce, distribute, or create derivative works based on our platform without explicit written permission; use our trademarks, logos, or branding in any way that suggests endorsement without prior approval; or claim ownership of any part of the Gamdato platform or its underlying technology. Your games and content remain your intellectual property. Using our services does not grant us any rights to your games beyond what is necessary to provide the service.
We strive to maintain 99.9% uptime for our services. However, we do not guarantee uninterrupted or error-free service. Planned maintenance will be announced in advance when possible. We are not liable for any downtime caused by: scheduled maintenance and updates; force majeure events (natural disasters, wars, pandemics, government actions); third-party service provider outages (Supabase, Clerk, Stripe); DDoS attacks or other security incidents beyond our reasonable control; or internet connectivity issues outside our infrastructure.
We reserve the right to modify, update, or discontinue any aspect of our services at any time. This includes: adding, removing, or changing features and functionality; updating API endpoints, parameters, or response formats; modifying usage limits, rate limits, or pricing structures; and deprecating support for specific game engines or platforms. For material changes that affect your existing integrations, we will provide reasonable advance notice (at least 30 days) through email notification and our developer dashboard. We are not liable for any modifications made to the service.
Either party may terminate this agreement at any time. You may terminate by deleting your account through the dashboard or contacting support. We may suspend or terminate your access if you: violate these Terms of Service; engage in abusive, fraudulent, or illegal activity; fail to pay for subscriptions after reasonable notice; or create security risks or interfere with other users' experience. Upon termination: your access to the services will be immediately revoked; your game's API keys will be deactivated; leaderboard and cloud save data associated with your games will be scheduled for deletion; we may retain certain data as required by law or for legitimate business purposes; and any outstanding payment obligations remain due.
OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO: IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT; WARRANTIES THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT; AND WARRANTIES ARISING FROM COURSE OF DEALING, USAGE, OR TRADE PRACTICE. WE DO NOT WARRANT THAT OUR SERVICES WILL MEET YOUR SPECIFIC REQUIREMENTS OR EXPECTATIONS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GAMDATO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO: LOSS OF PROFITS, REVENUE, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL; COSTS OF PROCUREMENT OF SUBSTITUTE SERVICES; GAME OR APPLICATION DOWNTIME CAUSED BY SERVICE INTERRUPTIONS; LOSS OF PLAYER DATA, SCORES, OR CLOUD SAVES; AND ANY DAMAGES ARISING FROM UNAUTHORIZED ACCESS TO YOUR ACCOUNT OR DATA. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).
You agree to indemnify, defend, and hold harmless Gamdato and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to: your use or misuse of our services; your violation of these Terms; your violation of any applicable law or regulation; content you submit through our platform; your games' collection and processing of player data; any claim by a third party related to your games or use of our API; and your negligence or willful misconduct.
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any dispute arising from or related to these Terms or your use of our services shall first be attempted to be resolved through good faith negotiation between the parties for a period of 30 days. If the dispute cannot be resolved through negotiation, it shall be submitted to binding arbitration administered by a recognized arbitration institution. Each party bears its own costs and attorneys' fees unless the arbitrator determines otherwise. You agree that any dispute resolution proceedings will be conducted on an individual basis and not as a class action.
We reserve the right to update or modify these Terms at any time. When we make material changes, we will: update the "Last updated" date at the top of this page; notify you via email at least 15 days before the changes take effect; and post a notice on our developer dashboard. Your continued use of our services after the effective date of the revised Terms constitutes acceptance of the changes. If you do not agree with the updated Terms, you must discontinue using our services and delete your account.
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
